Malaysia's Federal Court ruled in favor of a Malaysian curry restaurant after an eight-year trademark battle filed by McDonald's Corporation. Much to McDonald's dismay, the curry restaurant can use the prefix ‘Mc' in its name McCurry, which is short for "Malaysian Chicken Curry". [Kanageswary Suppiah, Co-Owner, McCurry]: "We are so happy that we can now put this thing behind us and start expanding our business - what we thought about nine, eight years ago, we would like to see a few more McCurries." McCurry serves Malaysian and Indian food and is totally different from McDonald's. [Sri Den Nair, Attorney for McCurry]: "There is no similarity in their business, in their foods an-d the type of customers they have. So it is totally different and that is what the court of appeal found, you know, that is what the court of appeal found." One customer eating at the curry restaurant agrees with the court's decision. [Suppiah Karuppiah, McCurry Customer]: "Nothing wrong, how can that be? This is McCurry House, McCurry House not McDonald's. McDonald's is different, their food is different. Here the food is different, isn't it?" The court dismissed McDonald's appeal because it failed to properly frame its questions when applying to challenge the appeals court's earlier verdict. McDonald's, which has 185 outlets in Malaysia, first sued McCurry in 2001 and a high court ruled in favor of McDonald's in 2006. McCurry then took the matter up to the Court of Appeals, which ruled in favor of the Malaysian restaurant. McDonald's subsequently took the matter to the Federal Court.

  • They deserved to win. There are alot of "Mc" names in europe. So should they not be allowed to use their own name.
