Whether it's misrepresenting the law of treason or the applicability of Miranda warnings, Fox News contributors on "Fox and Friends" this week spent a lot of time making a false legal distinction between citizens and non-citizens in the discussion of the arrest of Faisal Shahzad, the man accused of planting an SUV bomb in New York City's Times Square on May 1, as I show in this video.

The connotations of "declaring war against the United States" implies that individuals must plot to raise a coup d'etat or amass an army of rebels to overthrow the government or otherwise form a separate state. It can also include giving direct aid and information to a foreign COUNTRY.

That's kind of why you need two witnesses. In real treason, you have plenty of witnesses to your act as treason involves amassing some sort of army or revolutionary government, or sharing information.

Strange how Glenn Beck came across as reasonable there, despite perpetrating the false dichotomy that only citizens are guaranteed rights. Noam Chomsky said that if propaganda is doing its job, it will appear liberal. Maybe that was an instance of it getting under the radar.
