A legal copyright exists once the art-form is committed to a tangible format: written/printed, recorded, videotaped--even if the project has not been submitted to the Copyright Office. Art that has not been committed--only discussed or brain-stormed out loud, has no copyright--so keep this in mind when excitedly telling someone about your next planned performance/painting/book/music composition/video, etc.!
Really--people who want to imitate others would best show respect by writing the originator and asking politely for permission to do so. Just snagging someone else's brilliant idea is uncool.
