The heart is responsible for pumping blood throughout your body; the blood is responsible for carrying oxygen and nutrients to your respective organs. Whenever the heart stops beating your organs start to experience 'ischemia,' deprivation of the blood flow.

Whenever the brain has been deprived of the oxygen an explosion of electro-chemical activity is released as the brain taps into a sort of 'back up,' energy supply called ATP. However, because the brain requires so much fuel this energy can only last about five minutes. In order to conserve the energy, brain cells begin to shut down.

Although the brain cells are not yet dead, they cease functioning. A patient in this condition has not yet reached a state of irreversible brain death but does not have a functioning brain. Vitality can be returned to the individual with advanced resuscitation techniques and technologies, though this patient is clinically dead and does not have a heart beat or functioning brain.

Does such a patient lack personhood or is the potential for sentience + in the near future (should nothing interfere) suffice in determining who does and does not qualify for legal protection?
