Yes and no, from a legal perspective. You're right it would be a flagrant abuse of civil liberties for a govt to make wearing crucifixes illegal. That would be worse than a govt allowing employers to ban crucifixes, but not terribly so. If a person has a civil right, there must be extenuating circumstances or a margin of appreciation for a govt to sanction a ban, otherwise according to the EU Court of Human Rights, etc., it's illegal. See the reasoning in Dahlab v Switzerland and Lautsi v Italy
