That's the third bug I found with expose =(. The only one I had a problem with (and not even all the time) is when I do expose 4 finger swipe up and my windows won't come back down (they start to but then they go back). I was just trying to do it on purpose and it's not working, go figure.
I still love Snow Leopard though..
