Murray Feingold is old enough to retire. He has been a Postal
worker for over forty years. He holds a full time position, in addition to working extensive overtime.

Murray was happy for all those years until he was introduced to the judicial system in 2000. The landlord of the building he had been living in for the prior ten years refused to make what Murray considered necessary repairs, so Murray resorted to 'self help' and withheld a portion of the rent. The apartment that Murray was living in was rent controlled, so it is easy to understand why the landlord decided to start eviction proceedings.

Instead of eviction, Murray was placed under guardianship by Hon.
Anthony Cutrona Justice of the Supreme Court in Kings County, Brooklyn, NY in March of 2001 in order to protect him. This is when Murray says his life turned into a nightmare. When a
guardian is appointed for a person, all their civil rights are lost. Murray could no longer control his own money. The court ordered that all of Murray's salary, including all overtime pay must be sent to the guardian, a company ironically called Self Help Community Services, Inc. Each week, the guardian returns $325 which he and his wife are expected to live on.

A recent copy of payments made by the guardian on behalf of
Murray were impossible to decipher. Many of Murray's over due bills to places like cable and cell phone companies, as well as one credit card bill, were in arrears. Some were accumulating interest almost equaling the minimum amounts being paid by the guardian. There was no indication of the amount of fees taken out by the guardianship company as compensation for their services. For the forty years prior to having a guardian, Murray claims, he had no problems paying all his bills, including car payments.

What I found most troubling when I met Murray was that his most
essential needs were not being met.  He was in dire need of dental work. He was missing a few of his bottom teeth. He spoke fast and loud and kept asking me to repeat myself. I questioned him about these matters and I was shocked at his answer.

He told me that he had been having dental work done but when the bill became five hundred dollars, the guardian would no longer pay it.

He was more concerned with his loss of hearing which is having a
negative effect at his job. He says that his supervisor and co-workers find it annoying because they have to constantly repeat instructions because Murray can't hear them when they speak. Sometimes people mistake his loudness for aggressiveness. According to Murray, he had a hearing test done last week and he is totally deaf in his right ear and partially deaf in his left. He said that he had ordered three hearing aids from a company called hearing aid express using a personal check, but the guardian cancelled them.

It is hard to believe that a guardian of a person would not
immediately address the issues which are negatively effecting the health and well-being of someone under their watch but NASGA, the National Association to Stop Guardian Abuse reports that this is an ever growing problem because there is a lack of accountability in guardianship courts.

Murray has made his problem known to many agencies in New York, has contacted and emailed many New York state agencies, the first
lady, Oprah Winfrey, etc. and has been told that they can not help him. Murray says he has written to Judge Cutrona asking for a hearing in order to get rid of this guardianship so often that recently the Judge wrote back accusing Murray of harassing him.

Question. Why doesn't Murray just retire and quit his job?
Answer: The guardian will continue to get and control his pension.

Being a victim of a guardianship is like being caught in quicksand. You don't realize what you have gotten yourself into, and it is near impossible to get out. Murray's case is not an isolated one. Every day in every state across the country, guardians and conservators are being appointed, sometimes
unnecessarily and greedy, corrupt individuals are lining their pockets with assets that should go to the care of the elderly person.

What I find abusive Imamensa is that you exploited a person with issues for your own gain. You are not interested in helping Murray, for if you were you would have spoken to the guardian BEFORE you posted this. You took the word of Murray, and only murray. Does murray have family? do they receive income, as well? Might murray have ordered inappropriate hearing aides for his condition? Do you think investigations done about murray might have found his claims to be unsubstantiated?

Obviously, you are not reading what has already been posted. Someone already tried to call the guardian, and no response. Murray's case was fully investigated, and your only purpose is to being up irrelevant issues to take the focus off the main complaint which is that the man is not having his basic needs met. SelfHelf Community Services takes a commission out of Murray's money and they are not doing their job. Case closed.

@Pedrewthemegatard Actually people who are victimized no all too well how the system is not fair. If someone needs help the state should pay for it not the person who needs the help. This will take away incentive to prematurely appoint guardians.

GUARDIAN AD LITEM

I am a Guardian Ad Litem at the New York City Civil Court. First, there is NOT enough information in this video to determine why a judge granted an Article 81 Guardianship for this man. Second, I did NOT hear that he was medically re-evaluated. Third, as A Guardian Ad Litem, I provide a good service for people who are unable to defend themselves. I have defended a multitude of people from opposing attorneys who wanted to have them evicted. Thus, guardianship is not all bad.

@urgieingadavis so true, we don't know the whole story behind an old person being so called "abused" we don't know for fact if some people are being provoked to abuse the elderly.

maybe some old people are really the criminals, maybe some old people always start the fights, no one knows.

@wildstarfall my family also lives in an apartment and when we find problems with any part of the apartment needs repairs we put it in writing and give it to the landlord and if nothing is done we don't pay rent it actually states by the company that if we put it in writing the repairs that need to be done and give it to the land lord and she doesn't fix it we are allowed to withhold money until the repairs are done

He should find a lawyer some one who is willing to take his case to appeal the decision of the court also he should contact someone who is responsible for the apartment he lives in like his land lords boss write a letter to them explaining what is wrong in his apartment and what needs to be fixed and tell them that the land lord refuses to do anything about it and if this continues he wont be paying any of his rent ! MY neighbor had a guardian. The guardian paid herself every time she visited and charged $1.00 per mile to drive from her house to visit my neighbor and 18.00 dollars an hour - again from her house to see him every day. I know this because she told me so and bragged about it! This man gets social security but ownes his house... the way I see it the guardian is sucking this guy dry. The judge needs to know that using guardian needs to be a last choice not a first choice.

Amen to the NASGA. As a family member, I had to suffer on multiple accounts by the abuse of an incompetent lawyer, then a second lawyer who referred me to a so called "social worker" who in turn wasn't able to get secure funding for my loved one in the nursing home. Then the guardian appointed only cared about money and I doubt did any work regarding securing government funding for my loved one. It's a nightmare.

All guardians profit from the wards funds sir. That is a fact. Some states set limits but most leave it to be discretionary. As a social worker, you make referrals but probably have little contact after the fact when the estates are drained and the family is kept away.

Mr. Feingold is forced to submit his entire paycheck to these crooks since 2002.

Check out Clara1916 on youtube. Even after Clara passed away, her guardian tried to use Clara's cremains as a bargaining chip in his dealings with his former ward's family.
