Dog at yellow trailer at 5915 E. Frontier Seminole, TX

On February 11, 2009, I came across this perpetually chained large mixed breed dog with no shelter being provided to him EVER but especially on this cold, snowy morning. After speaking with the neighbors, this dog has not had a dog house since the man moved into the trailer. There is also another chained dog on the property but he does have a dog house. Both dogs are considerably underweight.

Around 9: 30 AM I contacted Gaines County Sheriff's Department and was told a deputy would be out. I asked for them to call me once they went out.

Around 2:30 I still had not heard anything so I gave them a call back and asked what was done for this chained out dog with no shelter. I was told by "Kevin" that he looked over the state statutes and there was nothing wrong with the dog not having a dog house and that it did not fall under animal cruelty. I told him then that I was going to find that out for sure because I thought Texas had state-wide limitations to 24/7 chaining and that a dog house had to be provided.

I then contacted the district attorney's office for Gaines County and spoke to Asst. DA 'Katie' Leininger. She told me that these deputies were inaccurate in their report that there is nothing that can be done. According to Texas State law, failure to provide shelter for a dog is covered under Penal Code 42.092 B3. It's also a Class A misdemeanor. She told me to call the sheriff's office back and tell them this information.

I then contacted Gaines County Sheriff's department again and spoke with Kevin again. I gave him all this information and asked that I be contacted by the deputy who took the call because I wanted to know what was going to happen.

It's 7:58 PM and I still have not received any word regarding enforcement of the Texas State Law.

Wanted to update everyone that two days later and many, many calls... the dog now has a dog house.

Now how do we address the issue that they are disregarding the state chaining ordinance?
