A second video of my encounter with a Northern Rail security guards and a PCSO at Hebden Bridge station. Earlier in the day the English Defence League had been demonstrating in Bradford. Some EDL members were apparently travelling back to Manchester by train, and the police weren't taking any chances. A Northern Rail security guard took exception to me taking photos of this unusual activity on the station, claiming wrongly that it was against railway bylaws. An earlier clip http://www.youtube.com/watch?v=yt8H7sdRdWU includes a conversation with the security guard. In this clip the PCSO states that my taking photographs makes him feel uncomfortable and clearly states his position on the issue.

  • Taking photographs at a railway station is not mentioned in the Railway Bye-laws. And guidelines for rail enthusiasts (on the Network Rail and British Transport Police sites) confirms that non commercial photographer is allowed.

  • @Fifty1stState - Technically its private property - but the Rail Response guy was wrong to say that it was against the byelaws without permission.The guidelines state that non commercial photography is allowed. The bye-laws he was quoting (see related clip 1) don't mention photography, but its difficult to argue against this when he's being backed up by a PCSO. The PCSO was also talking rubbish - he has no reason to prevent me from taking his photo. Note the proper police took no notice.

  • You can take photographs were ever you like in a public place as long as it does not deem to be for immoral use.

  • @TheEnglishInfidel Oh screw you. He's obviously wearing it over his shoulders & letting it run on Record Mode.

  • If the photographed is on private land they have a right to assert their privacy. If the photographer is, the owner has the right to restrct their access. Either way, you should also have a model release signed by the photographed if you want to make it available in the public domain - whether for profit or not. Furthermore, if the PCSOs believe that your activity may pose a risk to them, you, or other members of the public they can and should, ask that you refrain.
