Dr J. Buzz Von Ornsteiner aka Dr. Buzz offers his psychological insights in a transgender hate murder.
It started as a tryst, arranged online, in a quiet town in the shadow of the Rocky Mountains. She was an 18-year-old transgender woman. He was a 32-year-old rough-and-tumble gang member. It ended in homicide.
Allen Andrade, was on trial accused of murdering Angie Zapata. Andrade also had been charged with a bias-motivated crime. Angie Zapata was 18 in the summer of 2008 when prosecutors say she met Allen Andrade, then 32, on the popular online networking site, MocoSpace.
According to a police affidavit, the two arranged to meet, and Zapata brought Andrade to her apartment in Greeley, Colorado, where they spent at least two days together. During that time, according to the affidavit, Andrade says Zapata performed oral sex on him. When Zapata was out of the apartment, Andrade noticed photographs of Zapata that made him "question victim Zapata's sex."
When Zapata returned, Andrade confronted her. Zapata declared, "I am all woman." Andrade then grabbed Zapata's crotch and discovered a penis. What happened next is gruesome.
According to the affidavit, Andrade told police he began hitting Zapata with his fists, knocking her to the ground. He then grabbed a fire extinguisher and hit her in the head two times. He told police he thought he had "killed it," referring to Zapata, and covered her with a blanket. He then set about trying to clean up the crime scene. While doing this, he heard "gurgling" sounds coming from the victim and saw Zapata sitting up. He hit her again with the fire extinguisher. Andrade took Zapata's car and fled. Two weeks later, police discovered the car and arrested Andrade.
In his opening statements one of Andrade's attorneys, Bradley Martin, told the jury that while Andrade did kill Zapata, it was not premeditated. Instead, Andrade acted in a moment of rage upon discovering that Zapata was transgender. "He snapped," said Martin, adding that Andrade "flew into an uncontrollable rage."
The defense strategy centered on having the jury ultimately consider a second-degree murder charge, which could have resulted in a shorter sentence.
Martin also urged the jury to reject the bias-motivated crime charge, arguing that Andrade did not become violent because Zapata was transgender but because Andrade felt deceived. "It's not about a judgment of lifestyle. It's about a deception and the reaction to that deception." However, the jury heard jailhouse phone conversations, including Andrade telling a girlfriend "gay things must die." In addition, Andrade had also escorted Angie Zapata to traffic court where Angie's name was called out, but not as Angie but as his former male name, still listed on his drivers license, "Justin". There was also Allen Andrade's DNA found on Angie Zapata's vibrator - which may indicate that the two did have more of an inmate relationship over the 2 to 3 days than Andrade admitted. He did not testify in his own defense.

Allen Andrade was convicted of first-degree murder and a bias-motivated crime and sentenced to life in prison for killing a transgender teen he met on an online social networking site. It was the first time in the nation that a state hate crime statute resulted in a conviction in a transgender person's murder.
Seated in the front row of the courtroom, the family of Angie Zapata broke out in tears as the verdicts against Allen Andrade were read.

  • Well that's an irony, I'm trying to change the world for the better. And that's through the education. I'm bitter at the ignorance, because it is an ignorance of the man that killed this girl, if he knew that he was not making love with someone of the same sex, nothing would have happened. The sex is changed, just like sexual orientation and attraction leading to it. People have to learn, and not to see things black & white.

  • But i guess you're one of those who know more than i do. We all pretend and you know it. Just thinking about it, how arrogant it seems to be, telling people who they are based on what they see. What we are, in other words, our spiritual truth is in us, only we can know it. It makes me realize why in certain regions in Asia people with such condition are venerated, i presume because these people watch reality and life differently than the west.

  • @ubermisogynist the truth is alot of the times the guys do know and use the excuse of they didnt know to get off the murder

  • It is not OK for a transgender individual to not disclose status to a person they are getting involved with. You are born as you are, and if you try to synthetically change your gender, it should be revealed to someone you become sexually involved with. E.g. A straight man does not want to sleep with a "woman" who is a cosmetically altered male. It is biased in the interest of transgendered individuals to say otherwise because both people becoming involved are equally entitled.

  • This is so sad. Both families are without their loved one and everyone loses in this but he should have known i am so tired of these men talking about they dont know or when they find out they want to get all mad and want to hurt or kill innocent people but not blaming transgender people but they need to think before they try to get involve with anyone. my prayers go out to angies family !!

  • He killed him because he was deceived DUH! i bet 99% of transgender crimes wouldn't happen if they wouldn't try to trick straight people

  • @CardinalRaker We are women so if you can't get that through your head why should we even debate you? Science has shown the genetic cause and chemical cause for transsexuality, leading to in the case of transwomen female brains. Because society is still caught up on the fact that are genitalia doesn't match our appearance that's their problem and maybe if we had decent medical care and rights we would have better access to bottom surgery. We aren't deceiving anyone we are living normal lives.

  • That a terrible murder - it's horrible that somewould would murder someone they had just had a romantic attachment too - that's really awful.

  • @UpstairsMaid nothing will ever justify a trans the right to deceive someone. So if someone is a vegetarian do you have a right to trick them & put meat into their food without their knowledge or consent?Do you have a right to deceive a Jew or Muslim into eating pork or non-kosher food? In both cases if someone did I would still say killing them is not warranted but I wouldn't be surprised if one them had a violent reaction. They had a trans brag about tricking people in clubs that is not right

  • @CardinalRaker what amazes me is your ignorance and hypocrasy. next time a guy hits on me i'll be see to call my lawyer and sue them.. instead of reacting in horror to her murder you want laws to prevent a segment of the population from having equal rights. i thought you people already had a civil rights movement? pathetic

  • This is no different then when couples cheat. Women or Men sometimes go crazy and kill either the spouse or the person cheating with spouse. playing with fire when messing with peoples minds and emotions. Dr Buzz is an idiot.
