@thatguysaid.... Nystagmus cannot be controlled intentionally or through alcohol "tolerance" if you blew a .199 its is undoubtedly a certainty you exhibited signs of nystagmus. Heel to toe you would have failed regardless if the ground was even or not as at the BAC you noted your balance would have been grossly impaired. Chewing gum, and silence are indicators of possible intoxication, and chewing gum will not mask the ethanol scent as it comes from your stomach and exits through your mouth.
I solidly hit 17 before the officer told me to stop, after I had nailed the ABC's and count backwards numbers test. I'm pretty sure I passed the Nystagmus test as well. I politely debated the heel to toe test on the grounds of, well, the ground upon it would be taken, as it was broken and uneven, but I never refused the test.
At that point, he stopped the tests and had me take a breathalyzer. Uh-oh. I hit a .199 and I think both of us were stunned. Next time, chew gum and shut up. LOL
Please don't get upset, but when you demonstrate the test you are not keeping your hands down at your sides, like you are supposed to.
Your right hand is not hanging straight down, it is actually at a slight angle. Also, you need to tell the person during the instruction phase to look at you during the entire instruction phase and not to start the test until you tell them to start, and once they start the test, not to stop. Then ask them, do you understand?
We took this test last night at Citizens Police Academy. Several of us flunked it because we were klutzes! No alcohol involved. Better check the eyes to make sure!

Also, during the demonstration phase your foot was not parallel to the floor like it should be.
The person who was taking the actual test did keep her foot parallel to the floor.
But you did not demonstrate the foot position properly.
