Mrs Smith should have done following...
When someone asks for her name on phone... Do NOT provide it. Advise person on phone if there are any matters to discuss then it must be done in writing. Never acquiesce your details over the phone.
If you do decide to talk over the phone, then simply offer the scum aka credit card company $1 a month. There is nothing they can do. You are offering to pay off debt. Job done.

@garydn11234 With all due respect you clearly have a poor understanding of law. Statutes are simply rules & regulations. They are only given the force of law if we the people (the masters) give our consent.

@garydn11234 If a debt collection company decides to buy my debt without my consent, and there is no mention of 3rd party interlopers in contract, then you simply thank debt company for paying your debt off.
There is NO legal basis if there is no contract.

@riv2012 You are living in a dream world. If one buys a debt that you owe, you now owe that debt buyer. That is just how the law works, your vision of the law, notwithstanding.

@phwebbie You are wrong. I do commercial debt collection. I collect for business against other businesses only. I don't collect against consumers. I protect consumers who are bullied by debt collectors.

@Catgirl356 Catgirl, I am sorry to say that you have no idea what you talking about. I lecture on the FDCPA and file over 100 lawsuits per year under this statute. I can say, authoritatively, that my videos comply with the law. Let me clue you in on something; the FDCPA regulates only debt collectors and not creditors. You seem to think you know something about debt collectors. If what you said were true, I would not be filing as many lawsuits as I do against them....and winning

@georgekaotik In Michigan, we have the Michigan Collection Practices Act which regulates creditors.

@unrealhit88 You have no idea what you are talking about. If you had any idea what the Fair Debt Collection Practices is about, you would know that it only regulates debt collectors and not debtors. Comment when you figure out which way is up.
In the video they state - debt is overdue.
This is WRONG. Debt is NOT overdue, debt has been illegally purchased by debt collection agency (DCA) from bank/3rd party. There is NO contract between you (person with alleged debt) and collection agency. You simply DON'T enter into contract with DCA - that means say NOTHING on phone, and any paperwork they send you simply write on UNOPENED letter - No Contract Return To Sender

@riv2012 This is one of the biggest scams on the internet. Debt can and frequently is bought and sold. The buyer steps into the proverbial shoes of the seller and can enforce the debt. This "no contract signed by the debtor" defense never works because there is no legal basis for it.
