Tom Coburn is one of my Senators and although I don't agree with him on everything mostly because he panders to the socially conservative evangelicals here in Oklahoma but he's a pragmatist and he does what he feels is right. He's never worried about re-election, mostly because he'll get re-elected soon and it'll be his last term. He's one of the few good members of Congress whether you agree or disagree with him.

Well, if this penalty would actually take away life, liberty, or property if you didn't pay it (it doesn't, and the penalty itself is constitutional under Congress' power to levy taxes), then it would be constitutional. Why? Because it is LAW. Punishing someone for breaking the LAW is done through the process of LAW.

In other words, if you don't feel like paying the health care tax penalty, you might as well not do it. The provision is unenforceable. There's no punishment to not accepting the punishment of not buying health care.
It's mostly just a way to manipulate the sheeple. The Dems likely knew Fux Noise would only rant about how you would go to jail for five years if you didn't pay the penalty. Therefore, the sheeple that watch it would be scared into buying health insurance when they don't have to.

"However, [the health care mandate penalty] is not subject to the enforcement provisions of subtitle F of the Code.68 The use of liens and seizures otherwise authorized for collection of taxes does not apply to the collection of this penalty. Non-compliance with the personal responsibility requirement to have health coverage is not subject to criminal or civil penalties under the Code and interest does not accrue for failure to pay such assessments in a timely manner."
