Like many of you today I am here because I have lost my son to parental alienation. The county that helped legalize my son's abduction and abuse is Napa County, another small knit community of lawyers and judges. My son was almost five when he was taken from me. During visits with him I was denied restraining orders against his father who had a criminal history of domestic violence throughout our inundated relationship. During one visit I was sexually assaulted. The commissioner allowed these visits to happen, and on one specific occasion granted my ex a full custody order without my presence in the court room to even defend my child or myself. It happened with a snap of a finger and now my son is going on 11 years old, he is morbidly obese according to medical records, and last was known to have sores in his mouth, eyes, and nose.
Where has the court system gone wrong? Why are abusive men allowed to hold our children as weapons and tools of further abuse against us? Currently there are no laws protecting women and children in especially vulnerable situations. We do not have equal parenting, we do not have court appointed attorneys, we don't even have open courts. Judges and commissioners can do as they please with our cases and we don't have a legal foot to stand on. How do we fix these issues in our society so the children of tomorrow and my son, and your sons and daughters don't suffer in silence or vein?
Mothers For Justice is my organization and we have proposed several significant changes in the system. The first change is opening our courts. We must open our courts so cases can be heard and acknowledged. Mike Furer has proposed a similar law whereby opening up juvenile dependency courts around the state. This is a stepping stone to what needs to happen for all cases even simplified Family Law Cases involving children. Children cannot protect themselves it is up to us.
We would also like to propose having vulnerable women who have proven history of abuse to get representation by court appointed attorneys. Currently we give criminals public defenders, but women who are being abused and their children do not get any help. Family Law Facilitators and organizations that simply check off a box on a court form are insufficient. Our third change is to make a law giving equal parenting to women and men when their relationship ends. Just because two individuals are no longer together should not inhibit a child to have a mother or a father. Equal parenting from the get-go stops this all, but we are fighting an uphill battle because Family Law is highly lucrative to lawyers, judges, and the courts alike. The fourth change is to put in place laws against parental alienation specifically. A parent who is alienating without justifiable reason and a criteria of proof needs to be revoked as the sole care giver of a child. Parental alienation is child abuse. We must take the steps then to enforce and protect our children from parental alienation and abuse.
Mothers must unite. Our children must be protected, our future generation needs protected so the women of the upcoming ages do not face these same legal strains and battles. A child deserves both parents in their life and one judge or commissioner should not have sole power without community knowledge to allow this to occur. Parental alienation affects everyone in society and any child currently in this country can be a victim. It is happening at an alarming rate nationwide. There are hundreds and thousands of similar stories out there for woman, man, and child. We need to come together it is time to stop this in its tracks folks.
