Trial is Scheduled for Tuesday April 3rd 2012 at Yuba County Superior Court.

Thanks to the smart phone app Qik, even though our camera and cell phones were taken (and are still being held), this video was available when we got home.

Time and Date:
28 Apr 2011 around 1600 (4pm).

The specific location:

We were originally charged with PC 185 for wearing mask and PC 602 (f) for the sign.

A few months later they dropped the charge for wearing masks and added on for "resisting, delaying, or obstructing officer" PC 148. (a) (1).

Then on 10 Feb 2012 the charge for our sign was dropped, leaving only the resisting charge. We were also allowed access to our phones and camera to retrieve footage, which we hope to post soon.

Resisting, Delaying, or Obstructing Officer

148. (a) (1) Every person who willfully resists, delays, or obstructs any public officer, peace officer, or an emergency medical technician, as defined in Division 2.5 (commencing with Section 1797) of the Health and Safety Code, in the discharge or attempt to discharge any duty of his or her office or employment, when no other punishment is prescribed, shall be punished by a fine not exceeding one thousand dollars ($1,000), or by imprisonment in a county jail not to exceed one year, or by both that fine and imprisonment.

  • @KamekoBruns Adios, I am sure you'll continue to avoid simple questions in the future. BTW your most recent comment has been removed because you seem to be so feeble minded as to be unable to avoid ad hominems and I was clear in telling you such comments would be removed. Perhaps a class in reading comprehension would serve you well.

  • @KamekoBruns No straw man. If it is legal to not carry I.D., then how is it illegal if you do not provide upon request something you are not legally obligated to carry?

BTW I have no intention of taking my advice from a random individual on the internet, but rather the law professor who represents me, whom I will also assume you believe to be more knowledgeable than.

  • @benjaminbartholomew I'm sorry. Where did I say ANYTHING about US residents having to possess an ID card or face arrest for not having it? Are you even remotely capable of debating honestly?

All I said is that the USSC was quite clear in establishing the fact that you must identify yourself to LEA's when requested. That's all I said but you have to go and fabricate a strawman in order to win some idiotic argument.

  • @KamekoBruns If you believe an individual is required to posses I.D. at all times or face arrest merely for not having it, then you are wrong. If you think I am ignorant of the law, then what is your opinion of these LEO's thinking it is illegal to simply wear a mask?

  • @benjaminbartholomew "Governance can be paid for through voluntary interactions such as user fees." That's hysterical by the way.

Idiotic, childish and utterly clueless but hysterical nonetheless.

  • @benjaminbartholomew As for this stupidity "Please, negate the first part and make a logical fallacy of appeal to tradition and or to law." there is no need for an appeal to tradition.

If you are seriously so incredibly stupid as to hold that Constitutional authorization does not make something right or okay then you just tossed away your right to freedom of speech, right to freedom from double jeopardy and a whole host of other rights.

    Derp.

  • @benjaminbartholomew No idea. Don't care. The law is quite clear. LEA's are fully authorized to ask for personal identification in the process of an investigation. Maybe some idiot threw a fucking bowling ball over the fence a few weeks prior. Maybe some jackwagon moon cars from the overpass. No idea. Don't care. My post was merely to highlight your staggering ignorance of the law.

  • @benjaminbartholomew Oy. Yet another anarchist idiot who believes that "The People" will do it all. As for roads and railroads, I know full well of their origination. I also know that taxes are needed to help maintain them.

As for your feeble ad hom attempts at distraction, I'm not calling you an idiot in an attempt to negate your argument. You're argument is pathetically feeble and easily negated.

I'm calling you an idiot because you are an idiot.

  • @KamekoBruns What crime were they investigating?

  • @KamekoBruns

    PS

Disagree all you want, but you aren't capable of making statements without ad hominems, they will be removed.
