The song wasn't stolen from ANYONE. And also, since this is from a mixtape which is FREE, he doesn't have to ask for permission, since he doesn't make any money from it.
Also this melody go back further than just Mario Winans..
The first one to produce this melody was an Irish singer named "Enya", back in 1992. Then "The Fugees" sampled it for their song "Ready or not" in 1996.
Mario Winans then sampled it for his song "I don't wanna know" in 2004.
And now Chamillionaire sampled it.
