Tobi could very well be a clone of Madara or his brother, yes he died but that shouldn't be the case, Madara knows of Tobi meaning that Tobi has been around since Madara was alive, it was stated that Madara got the Rinnegan before he died but it was never stated that he died RIGHT after got it, maybe when he got it, he brought his brother back to life with it and made these plans, idk just some type of speculation.
