On December 13, 1903, Italo Marchiony received U.S. patent No. 746971 for a mold for making pastry cups to hold ice cream. Contrary to popular belief, his patent was NOT for a cone and he LOST the lawsuits that he filed against cone manufacturers for patent infringement.
Also the International Association of Ice Cream Manufacturers (IAICM) has given Ernest A. Hamwi the credit for inventing the cone.

No decision has to be made here. When you have the patent, all the other claimers have no basis to work with. Enough said.
