  • That is right! The 10th Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The only reference to Habeas Corpus is, "The Privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it." With no mention of delegation of power to suspend it, it is reserved to the states or the people.

  • yes, that is true except inmates in our luxurious prison system. THEY keep up the good fight. Our government ignores it however and bullies the very citizens paying for their spawn to attend private schools they deny the citizens. As to its suspension, we are not in rebellion or being invaded, which is my point exactly. Thank you for your response.

  • Section 9, the only place that even mentions the writ.

    "The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."

    Just to point out one thing though... If you pay attention.. The constitution is pretty well ignored anyway. People do not read the constitution with even a thought of original intent.

  • The constitution fords the opportunity for the writ to be suspended ddsharper.

  • Article Five of the Constitution spells it out: "The Congress, whenever two-thirds of both Houses [the House and the Senate] shall deem it necessary, shall propose amendments to this Constitution . . ." States were also given a chance to propose changes, or amendments. Three-fourths of the states have to approve the amendment for it to become law.

  • Fantastic commentary, I did not want it to end. My sincere gratitude and appreciation for Mr. Olbermann for his brave, candid and passionate defense of American values which are all based on respect for human rights, against torture and against unlawful detention of 'anyone'. What Mr. Bush has done is againt what we all believe in and what a SHAME that he got away with it. I just wish more reporters would speak up as Mr. Olbermann has done. Many Thanks!
