Unless you have some kind of comprehension issue, an attorney or CPA not necessary. This information is everywhere and easy to understand if you read. People are just flat out lazy. I've been a LLC and S corp business owner for over ten years and started each one of these by doing my research and reading. I file my own taxes and prepare all the forms. Don't get intimidated by this people! How can you fully understand your business if you don't understand how it's set up?

@desertdude1234 If you create an LLC in your state, no one will be able to create a business entity with the same name in your state; however, this does not protect the name nationally and it also does not protect you from having others use that name without your permission or from others making money off of the name you created. I think you really need a trademark to protect the name so that others can't use it without your permission. Hope this helps.

@DwayneLattimore I agree with you. $2200 is a lot of money for this simple service. I do a lot of networking with other business owners and I often ask how much they paid for this service. Usually I hear that they paid around $500. Even $500 is more than I charge for this simple service, mainly because I would prefer a client consult with me prior to creating the entity to be sure it is done correctly than having to go back later and fix mistakes. Fixing mistakes is much more costly.
I agree that you do not need an attorney to form an LLC; however, you need an attorney to determine if an LLC is the right entity to meet your needs. There are a lot of different entities out there. If you live in Ohio, I provide a lot of resources for you at my website at TibbsLawOffice

@TibbsLawOffice I agree. This video was just for the basics and fundamentals. Many professionals aren't always forth coming about how simple some things really are and have no problem taking someone's money. I once asked an attorney how much just for kicks and they said $2200. Wow!

Hmm stunned and confused to see the trademark/tradename forms and super low fee's at my Secretary of State website, compared to the USPTO trademark fee's which I thought were around $245. I'm trying to protect a clothing brand name and create an LLC with the same name...still havn't found LLC forms on SoS site, although LP I did find, keep looking. Does the LLC protect the name atleast? So... many questions...must..entrepreneur

@desertdude1234 Your name will only be protected by the state that you're getting your articles of organization in. This is why when someone wants to brand something nationwide it can become VERY expensive.
