13. This is a civil rights action against employees and the agencies of the Los Alamos National Laboratory (LANL), the University of California System, the National Science Foundation (NSF), the United States Department of Energy (DOE) and Cornell University (Cornell) for depriving Plaintiffs Robert V. Gentry and the Orion Foundation of established constitutional and statutory rights.

14. This action seeks a judgment declaring that the regulation, policies and administration of the above-named defendants prohibiting and suppressing the publishing of legitimate scientific work on an open, federally and state funded scientific forum contravenes the First, Fifth and Fourteenth Amendments to the United States Constitution (U. S. Const. Amend. I, V, XIV.) and 42 U.S.C. § 1983 as well as Article I, § § 3, 8 and 11 of the Constitution of the State of New York. This proceeding also seeks an injunction against the current administrators of the arXiv database and Cornell University enjoining them from continuing to prohibit and suppress the submission and posting of Plaintiff Gentry's scientific work, as well as damages resulting from such prohibition and suppression.

Texas Education Officials Strike Blow to Academic Freedom
Dear Friends of ICR:
As you may have heard by now, the ICR Graduate School's application to grant degrees in Texas was rejected yesterday by the Texas Higher Education Coordinating Board. Many of our friends and constituents have been praying for us during this time, and we thank you for your intercession and your help.

Critics have attempted to draw false associations between the ICRGS program and attempts to introduce religion into taxpayer-funded public schools, even though the ICRGS is a private postgraduate institution seeking to train science educators for private schools.

Questions have surfaced concerning the treatment of the ICRGS application by THECB officials and whether Commissioner Paredes and his agency altered the normal process of application review because of external pressures based on ideological biases against the ICRGS.

Under Texas law, the ICRGS may appeal the decision of the Commission or seek other remedies as appropriate.

Your evidence is obsolete. The idea that the athmosphere was oxidizing came from bubbles trapped in fossilized amber. It has since been realized that reactions within the amber produce oxygen, increasing the content of the bubbles.

There is no cosmological or genetic evidence of a creator.

Ken Miller is a catholic. He wasn't ostracised or discredited.

If you don't teach these things, then you're not truly being "open" and are not "advocating free speech" by your logic.

It is painfully obvious that this intelligent design (ID) movement is not only "creationism" in disguise, but is also Christian based.

I highly doubt that these "fundies" would want any of the things I listed to be included in ID.

In other words, talk of "openness" and "freedom" is merely a guise. They just want their "creation science" in the science classrooms (yuck!).

I believe in evolution. I also believe in a higher power (not religion specific).

I cannot prove that my God exists. I cannot rationalize his/her existence either (rationale actually serves to hurt it). But, spiritually and emotionally, I have faith that he/she exists.

Now, this suggestion is GREAT! But more must be added to truly be "free". How about we also teach about:

1.Muslim, Buddhist, all other Gods

2.the flying spaghetti monster

3.alchemy

4.astrology

5.Greek/Roman gods

6.Satanism
