Yes, ROMs are legal so long as you own the real game, otherwise ROMs are technically illegal, but "abandonware" is a software product, especially a video game, whose copyright is no longer defended or which is no longer marketed even by the company who made it.
Noone cares about ROMs for NES, SNES or w/e old school consoles. The developers make no money from it in any way anymore.

It's actually a grey area. If you were to be caught downloading the ROM, you could be prosecuted even if you own the game because ROM distribution is illegal. But if you make the ROM yourself, the chances of getting caught are slim. Some companies like Nintendo still vigorously defend the copyright of their older games, and explicitly state that it is illegal to make a ROM image of their games, even if you own a copy. Most older games do fall into the abandonware category, though.

I'm glad that the line about the "DreamCast, PSP, and DS" has sparked some discussion. I've read many articles and listened to journalists and developers argue about this topic. I'm of the mind that there is no "lost sale" because the pirate would not have bought the product in the first place.
Thus, console sales can only benefit from being 'pirate friendly'. Piracy didn't save the DreamCast nor is it a huge factor in handheld sales - but I know too many pirates to rule it out.
