Viacom appears to have abused their ability to remove videos and entire channels through copyright claims. While I have always agreed that their property should be protected and should be removed if they needed it to be. This time they crossed the line. Actually they have done this many times before. This is not the only time Viacom has acted very aggressively with people on the internet. They do this because they are a large corporation and think they can get away with it. For the most part they have.
Recently some trigger happy person at Viacom took down the video Viacom vs you from youtube. It was obvious to everyone that there was absolutely no copyright issue with that video whatsoever. Yet it was still removed. Most videos that are taken down unjustly never see the light of day again. I am only back up now because of all the support from my viewers.
This is not just a Viacom problem, it is also a youtube problem. Anyone can accuse any channel anytime for copyright infringement. It is up to the accused to prove their innocence rather then the accusor. From what I have seen there are no severe penalties for a false copyright claim made by a channel or a business. Channels and businesses that make more then one false copyright claim need to be punished severely for their actions. This is a very serious subject on youtube and around the net. This has happened multiple times to many different channels.
There is also no distinction between a copyright infringing video and a video dealing with fair use.
TRADE MARK / COPYRIGHT INFO:
Trademarks and "service marks" — are governed in the U.S. by the federal Lanham Act, along with various different laws in the individual states. The basic purpose of trademark law is to protect consumers by enabling them to rely on recognizable marks to identify the source of goods and services.
It follows that unless there is a likelihood that the unauthorized use of a trademark or service mark will confuse consumers, there is no violation of trademark law. In many cases, courts don't need to address fair use or other possible defenses because there is no real likelihood of confusion.
But trademark rights are closely related to a number of other rights, and trademark owners will also frequently make claims about "dilution", "passing off", "unfair competition", or the "right of publicity".
"Trademark dilution" lets owner of a "famous" mark stop any use that blurs or tarnishes its distinctiveness ( Not Reputation) — even if there is no chance that consumers will be confused. Because the concept of dilution has such potentially broad reach, there are specific defenses in the federal Lanham Act that are applicable to claims of dilution. "All forms of news reporting and news commentary" are exempted, as are comparative advertising, and "noncommercial use". The First Amendment and state constitutional protections for speech provide additional protections for news reporting and commentary.
While I do state certain legal items in my videos and in my text it is up to you to do your own research. I am here to shed some light on a pretty dark subject, but by no way am I responsible for any conclusions you draw from my videos or my information. If you are going to act against someone for anything dealing with a copyright lawsuit. Hire your own attorney and go over your claim in detail with them. The information I provide is to give people an idea of the laws, but not to be the only source on them.
This subject is not over. Until youtube provides me with the proper documentation, we will not be 100% certain that Viacom did this, but all signs to point to them. Youtube still has yet to provide me with the information I have requested.

@Zizzister That's true. I know this video is about the original videos, but I still don't get it. Nickelodean sucks nowadays anyway so it's not like they'd be getting any more money.

@vidgmrjoe Just because you state in the video info "I do not own spongebob" doesn't mean you are safe from Viacom or Nickelodeon or whoever owns the show. Youtube can still remove the video because if people go on youtube and watch the episodes, the copyright holder would lose money on the show as well as their copies on DVD.

I made a youtube poop video, and while I do not own spongebob, Viacom said that Viacom owns my video and that I should watch out for copyright infringement. I had the DVD, and I said "I do not own spongebob" But they still blocked my video
