The talks have been restarted on final status issues after the Annapolis conference in the US last month but very little has been achieved.

USA GTMO Military Commissions are a disaster because Bush 43 Admn pursued to circumvent LOAC through its bullshit "enemy prisoner of war [EPW} " detainee designation.  Is there any other kind but enemy POW's?

OR Parties may either prosecute through their respectibe civil jurisprudential system: IF, it has the legal authority to do so; Case Example- Saddam Tribunal or Norway's recently enacted laws.

OR the UN may establish a Tribunal under the the auspices of the Interanational Criminal Court (ICC) which is also conflict specific.

GENEVA War Crimes Tribunals MUST convene in the territory WHERE the person is captured, e.g., State where conflict happened.

Military Tribunals: Parties to the conflict may establish respective or Joint Military Commissions as in Nuremeberg & Tokyo Triibunals

War Crime Tribunals are conflcit specific; do NOT have appeals due to the fact that once adjurned are finito forever; penalty is what Commission determines

Penalty is usually death becuase a live prisoner may opt to pursue political, legal, or propaganda appeals-No one wants to deal with that

Ive read the Article 49 that you refer to and it is clear that Israel is in breach of each part. My next question then is, what are the penalties for failure to follow article 49. When i read it Article 49 did not state what the penalties are.

Word "civilian" is a military term that equates with "Protected Person" but Niether ais combatant nor non-combatant

I-973 Geneva Article 49 defines importation of one's citizenry as War Crime & said person are EXCLUDED as protected persons: Therefore, Israeli settlers are NOT civilians but War Criminals & can be killed should they offer resistance

Its comparable international law context [plunder] to domestic "looter" who can be killed on shoot on sight
