There will always be cheesy sci-fi films (look at Inquisitor, for one thing). Just because it was made by amateurs, why should it be banned (This seems to be the point you're making).
For the sake of Freedom of Speech, the film should be allowed.

@HuVuTorwaechter Well then I guess I was mistaken and I apologize for that. My understanding of the situation is limited to what I've been able to find online as I don't know much about copyright law. In that case I think GW should look very closely at all law involved and do whatever is in their power to enable a release which avoids any legal issues and makes future projects like this to enrich the world of 40k. The Emperor protects.

Bad move, GW. Fan movies help get more pple interested in the W40K franchise... why so tight-assed about it?
Hate to rain on you guys' parade, but GW are NOT "Just being a damn bully" and the issue has absolutely nothing to do with free speech. The problem is an issue with German copyright law which means that, in essence if Games Workshop were to allow Damnatus to be released it would, in essence, make 40k part of the public domain in Germany. I may not like the fact that it's not allowed to be released, but you guys are blaming the wrong people. A better idea would be to revise German copyright law.

@joshcripe42 Several lawyers we have spoken to said that there is no problem with codified German copyright law. 40k can in no way become public domain here. The BBC article about the DAMNATUS case showed that it's the British case law that leaves a gap here. Many copyright legal specialists among the Wh40k community from England as well from Germany told me that it's very likely that Games Workshop did not understand fully the whole situation and therefor shut us down, taking the safe road.
