Section 107 of the USC states that news reports, which would include gaming news, which is what machinima did, can use clips of copyrighted works under fair use and its not considered infringement.
This is why all the major networks are allowed to show semi related clips from other news broadcasts or any other source with the protection of the fair use provision.
Unlike video game playthroughs, this has been tested in courts.
