I would think that Obama wont push trying to put the torture crew to court in the short term, while he tries to keep the republicans in line to rebuild the US economy and reputation first. perhaps by the time he gets to his second term, he may try for justice, but im not expecting it short term. I mean, knowing how fractured the people are at present, trying to put gitmo under right away would further weaken his hand. Go after gitmo=piss off the rebs=lose control of the country,and he knows it.
Of COURSE we shouldn't prosecute the outgoing administration for war crimes, torture, etc.
After all, we wouldn't prosecute a pedophile teacher who was retiring.
Oh wait... Yeah we would - and we should. There can be no more emphatic message to future administrations than members of a prior administration sitting in federal prison cells.

Obviously, 2 different parts of the Obama administration, justice and treasury, can do 2 different things simultaneously. It would be a huge, precedent setting mistake to let these crimes go uninvestigated and unpunished. It would effectively codify Nixon's statement "if the president does it then it is not illegal." Bad Idea Genius.
