Frantz Pierre decided to protest just after midnight (officially 12/04) after LAPD called yet another unlawful assembly on protesters on the West steps of City Hall.
Mayor Villaraigosa declared the West steps a free-speech zone while the park was closed for renovations. Apparently that comes with some restrictions.
Obviously exercising his first amendment rights, Frantz was arrested for trespassing. Trespassing of this sort is normally treated as cite-and-release -- with a ticket written and an order to appear in court. Instead he was arrested, officers said his bail would likely be the same as other Occupy LA protesters arrested on the night of the eviction -- $5000.
Since the eviction that used 1400 riot cops against peaceful protesters, with some serious cases of media manipulation and brutality, the LAPD has consistently harassed protesters at this site, including giving traffic tickets to people dropping off food, blankets, and even once for someone honking their horn in agreement with the protest.

You have the right to protest 24/7 (of course one has to take into consideration others who want to use the same area, if needed). "they made it clear" When slavery was legal, that too, was made clear, in fact, it was on paper. The mere fact that they "made it clear" does Not make it legal.

Thank you for posting this. We must always keep in mind that this officer is not the enemy. He is saying "we" because in his world view, he thinks or is lead to believe he is a part of the elite class. In the end, their power is minimal. They are nothing but speechless dogs of the police state. Sooner or later most of them will realize this themselves as their own family and friends come under the thumb of the system.
