Spratlys solution: Law of Seas

MANILA, Philippines — Senate President Juan Ponce Enrile said the best way to resolve the Spratlys conflict is by invoking the Law of the Seas under the United Nations Convention on the Law of the Seas (UNCLOS), especially if other nations are violating the country's exclusive economic zones (EEZ).

"We can invoke the Law of the Seas to the UN if they would violate our exclusive economic zone because there's a treaty among nations," he said.

As the conflict heightens, United States Ambassador to the Philippines Harry K. Thomas Jr. Tuesday assured the Philippines of the US government's support to the country in resolving the issue, reiterating that the Philippines and the United States are "partners" and "treaty allies."

"I want to assure you that on all subjects, we, the United States, are with the Philippines," Thomas said in his speech during the launch of the National Renewable Energy Program (NREP) in Makati City Tuesday, which was attended by President Benigno S. Aquino III.

"The Philippines and the United States are strategic treaty allies. We are partners. We will continue to consult and work with each other on all issues, including the South China Sea and Spratlys," Thomas said.

Enrile said that while the Philippines can invoke the Mutual Defense Treaty (MDT) it has with the United States, he doubts that America will come to aid the Filipinos in its fight against China should the tension escalate.

It is also premature for the government to invoke the MDT to resolve the ongoing conflict with Beijing.

He said the Philippines can only invoke the MDT if there is an attack on Philippine Navy vessels or any aircraft within the areas covered by the treaty.

"Now, if there's an attack against our naval vessels or against any of our aircrafts within that air space from the coastline of the western side of the Philippines all the way to the mainland of Asia, or all the way to the coastline of the Americas, then we can invoke the MDT because that's the treaty area," Enrile said.

Enrile also said the government's use of the West Philippine Sea to refer to the disputed islands situated in Spratlys is only appropriate and is no way a sign of the Philippines aggression against China.

As far as he is concerned, Enrile said that portion of land now being contested by the two countries belongs to the Philippines.

"This is our sea, as much as the sea of China. China is not the owner of the sea. Freedom of the seas as Grotius, who was the pioneer in international law, said," Enrile said in an interview.

"If you look at the physical condition of Palawan in relation to the (disputed) islands that we occupy, these are parts of the mass of Palawan Island," he pointed out.

Thus, the government is correct in using the term West Philippine sea to refer to the islands which China is claiming as its own.

"Hindi naman aggression iyon. Gusto mo lang sabihin ay yung tubig na ito ay West Philippines. Yung tubig doon sa Northern phase ng Luzon ay Northern Philippine Sea. All the way to whatever (That is not aggression.

Malacañang seems bent on playing the name game to assert Philippine sovereignty over disputed areas west of the archipelago, this time concerning an island some 100 kilometers off Palawan province.

Days after presidential spokesperson Edwin Lacierda started referring to the South China Sea as the "West Philippine Sea" in official statements, the Palace aide on Monday spoke of the "Recto Bank," which he said was the "proper" name of a spot otherwise marked on most international maps as Reed Bank.

"The administration has always asserted that it will dismiss out of hand any claim to what are considered integral parts of the Philippine territory such as Recto Bank in western Palawan," Lacierda said in a media briefing.
