Allright, here we go:
let me start off and admit my actions were not the right ones to take, since this happened almost 5 years ago and i was just a kid compared to now. heres what happened:
we were finishing up the editing of our skateshop video, and most of the skate team was over at my apartment partying or whatever. while i was inside unaware of what was going on, what had happened was two of the kids there had been playing on razor scooters out in front of my house which happened to be a big open slab of cement that was going to be a construction site.
someone called the police, and when the kids saw the police a block away, they ran into my house with the scooters. I still did not know what had gone on at this point or why the cops were even there. everyone present at my house sat in the front room while i talked to the two police at the door. i continually asked what they were at my door for, and magana would say "whichever two kids just ran in here, those two kids come out or else you are all going to jail." there was about 8 or 10 kids in the room, and no one spoke up, and i didn't even know what he was talking about because i had not seen kids run in, and hadn't known they were even out playing on scooters.
no one acknowledged it, and so i said, "ok, i cant help you, but this is my house i don't even want you here, please leave, you dont have a warrant." and i shut the door on them several times. he kept opening the door and began to say that we were all going to jail since he didnt even know whos house it was. this was about the time i started videotaping.
i think i had recently had a bad experience where i was innocent in something, like shooting photos on a public place of my friend skateboarding, and having a policeman come and give BOTH of us tickets for skateboarding/vandalism (which are very expensive and were hard for me to pay making minimum wage) and so when he was at my door, i did not want to be involved in whatever it was he was there for and get charged with it since i literally was not involved. finally, i got my drivers license to show him that the address matched that of the house he was at. you see in the video me reading my name and address of the house and he asks to take my ID. I knew at that point he would take it, radio in my name, and it would already be the beginning of a police record since everyone they have contact with they file an FI (field interview).
I didn't want to be a part of whatever he was there for, and i knew they didnt have a warrant, so at that point i wanted them to leave. in the video you hear me say "i dont want to give it to you" as i start to pull my hand away. you can hear i am not yelling and i am not making any threatening motions.
Immediately after that, the second police officer steps in, puts me in a full-nelson, throws me face down onto the cement outside, and puts his knee in my back and handcuffs me. as i am pulled out in the video you hear me say "what the fuck is wrong with you?"
Then magana proceeds to enter my house without a warrant and they came in and took out all 8 or 9 kids and handcuffed all of us.
now you asked me why its called 'fuck the police', well, more accurately, you are right, it should change to something more like "fuck police who are like this".
to my knowledge to this day, it was not legal for the officer to enter the house, and after this happened, my lawyer said the same thing and he was furious about it. there was no warrant, you can't enter. and then excessive force was used on me when i posed no threat.
dont get me wrong, i appreciate the work police do when they are not corrupt. some of them are good people that are in the position to actually protect and serve people. they are among the people who hold our communities together. these men, however, were power hungry perverts.
now that i said i have grown up, what did i learn from this? how would i change my actions? I learned that police can do nearly anything they want in their position, and will always win in almost any court battle. i learned that you need to ask these kind of questions later, and while the cops are there you need to do whatever they say. if you get pulled over and a cop tells you to stick a dildo in your ass, you had better do it, and then write down his badge number and get him fired later. thats what i learned. this little incident that you see here is on my permanent record as a 'violent encounter with police' which as you can see never did i assert any violence, and because of it any time i have an interaction with police i am automatically profiled as soon as they get that information back when they radio in my ID. so yes, fuck police that is, fuck police like that.
