How long can I stay on SSD / SSI Benefits?

The simple answer is if you stay disabled you can remain on those benefits until you get to be sixty two or sixty five in which case your check will simply be transferred and come out of the Social Security old age retirement account instead of the disability account and it could go on for the rest of your life. Now SSI benefits are a little more complicated because in some circumstances a person was not eligible for Social Security Disability Benefits and therefor get SSI Benefits but yet when they achieve your typical Social security retirement age they are able to get a Social Security Disability check. Say from previous earnings or perhaps from a previous or deceased spouse in which case their SSI benefits will be cut off and they will then get an old age Social Security check. The other possibility is your benefits can be terminated if your mental or physical condition improves to the point at which you can work. Because of this Social Security frequently does continuing disability reviews in which they ask you to send in your latest medical records to show that you are still disabled. Typically this is done every three years or so unless you are sixty something in which case they feel its not worth the effort. Of course if your new records show that you have improved you could be thrown off of Social Security Disability. If you disagree with this decision you can start the appeal process all over again and eventually end up with another hearing say with a Social Security Judge and try to convince them that you still deserve to be on disability.

Retaining a Social Security Disability Lawyer is essential in obtaining legal representation before the Social Security Administration. Social Security Disability lawyers should work on a no fee if no recovery basis.
