Anyone in New York can look up the law of guardianship for the elderly in the "Mental Hygiene Law Article 81". Within that law there is a section on the "powers of a guardian" which every person should read. After reading it, you will realize that everything you imagined about your civil rights or due process was a figment of someone's imagination. Remember, forewarned is forearmed. OMG!!! How sad! I am a CNA in a nursing home and this is soooooo uncalled for! God will give them what they deserve! Bless your heart, I know you must be in alot of heartache over this! I would NOT give up. I would even contact the governor or my elected officials ASAP!!

A similar thing happened to my mother as well. My sister did this to my own mother and told her she had mold inside of her home. Took her out of her own home ; other sisters robbed her of all of her possessions and then they all divided her belongings without her realizing it. She had dementia. I tried to help her but I live in a different state and did not have the funds to prevent legally what my siblings were doing to her. Sadly my situation is the same as yours and the laws are screwed

In my father's case in New Jersey, misconduct of the guardian has repeatedly been reported to the Judge Walter Koprowski. The Judge has refused to take action. He even quoted the Wolosoff case which requires a plenary hearing but the Judge refused to hold a hearing. The Judge has shown his bias in favoring attorneys and treating pro se's in a discriminatory manner.

Abuse of ANY kind is NOT justified by the Holy Scripture. Nevertheless, light ageism isn't justifiable either. VERY great points are made but, please note that in these last days abuse is also coming from elderly people (mostly verbal abuse) and the younger adults response is physical.

The last time I checked, 50 or 60 yr. olds didn't qualify as elderly and I am very well aware that anyone can be abused by anyone but that's not what we were discussing. and i have not seen many 15 year old children that could beat up on elderly people unless those elderly people were in there late 90's or if they had wheel chairs. a 60 year old or 50 year old elder adult which would be a young elder, can for SURE beat you up. they are sure not as weak as children or teens or anything even close. and any one can be victimized by ANY ONE in abuse, abuse hurts every one!!!! don't discriminate me. just because i am not a very strong person who is NOT old!

that is so not logical or true, i have bin attacked by an elderly person and she was allot stronger than any child that's for sure, cause she was so big, i think people like you over exaggerate when you call elderly people weak. most average elderly people i have seen in my life can atleast beat up any child ages 15 and under.
