I think the present criteria of "illegal" were not applicable in 19th century. The settlers had different status. For example Jim Bowie was a Mexican citizen.

The Texian colonists were invited to live in Texas and were given rights as Mexican citizens under the Mexican Constitution of 1824. When Santa Anna came to power in 1833, he destroyed the constitution and set himself up as a dictator. Several Mexican provinces revolted against his centralist rule, including Zacatecas. When Santana crushed the rebels there, he allowed his soldiers 2 days of rape and pillage in which 2000 civilians died. He then turned his sights on Texas. The rest is history.
