Theres these things called disability checks. Watch a movie called "The Blame Game" its on how people like this don't take responsibility for their actions and just sue, sue, sue. For instance a scenario on the video is when a man riding a bike was hit by an SUV at night then sued the bike company for the reflecters being dim.

disagree. a conductor has a good deal of responsibilites to juggle. you don't know if he actually had enough time to tell what or if there was anything on the rails, you're just assuming they found that out.
most importantly, i think you should realize what you're arguing. step back and look at it. you're saying it's the conductor's fault for not being 100% vigilant 100% of the time all day. Haven't you been on a road trip before? it's not his fault that a drunk guy landed on the track.

how about this one, don't fall onto train tracks, or wait for those big yellow things that try to obstruct your path when trains are coming, and also, if you fall on train tracks, even while intoxicated you should know to fucking move..
or not be outside at all, and if the guy was driving and fell out of a car, crashed, etc.

so although you are taking alot of liberties with the case assuming there was enough time to stop etc. I would wonder what a guy like you would say about people breaking into your house and getting cut on a sliding glass door and then suing you and winning money... because THAT happened and does happen all the time. Don you feel if someone BREAKS into your house, if they slip and fall, YOU shouldn't get in trouble for not having a safe environment for a burglar to come in?

Why is everybody using that analogy? That's not even a good analogy. They have nothing to do with each other. It was the burglars intent to steal from you, it wasn't Dibble's intent to plan getting his leg taken from him. Here's a better analogy for you. Lets say a person was driving and someone accidentally stumbled upon the road, drunk or not. Are you saying that the driver isn't responsible at all for hitting the innocent pedestrian? Please read my blog for a more detailed opinion about this.

not an analogy buddy... i was ACTUALLY asking what you would say about that specific incident ;) i aint speakin in tongues and asking you to read between the lines...I am asking EXACTLY how you feel about THAT exact incident? Do you feel THAT is pretty ridiculous?...feel free not jump to conclusions and ASSume things...I asked a question and THAT was the question I was curious about, sparking a convo, smartypants, lol.

Alright. Yes, I feel that it is ridiculous and unfair. It's not exactly the homeowners responsibility to provide his/her (uninvited) guests a safe robbing experience.
