Emmily came into this world in January 2001 to her mother Erika Mendieta & father Derrick Parra.

She was voluntarily given to her paternal aunt as a baby. Emmily grew from baby to toddler in Selena Parra's
caring & loving home.

Selena raised her "as if she was her own child."

Erika said she had not wanted to give Emmily away "not because I wanted to but because there was a whole family against me."

July 2003
Emmily's mother insisted on taking Emmily with her for a two week visit.

She lived with her six siblings, her mother & common law husband Johnny Bermudez.

Two weeks passed and Erika refused to return Emmily to her aunt. A court date was set for November 23 2003 to determine custody.

November 13 2003
Erika Mendieta called 911.

"I need an ambulance...My little girl is dying. She is dying on me,"

Erika Mendieta told police that Emmily had fallen down the stairs a day before. She began to have a seizure a day after while she was laying on the couch.

"Her limbs started to turn in different directions,"

"Her teeth were making a chattering noise."

"She was gasping for air."

Emmily had suffered blows to her head and neck that were inconsistent to falling down the stairs.

She had bruises on her ears, stomach, back, legs, groin, arms and around her eyes. "looks like she has been in a bar fight,"

Emmily flew away ten days later at just 34 months old.


Erika Mendieta admitted to have "physically disciplined Emmily," but also claimed she was picking up her other children at the time Emmily was injured.

"She would strike her on the arms, on the legs, on the buttocks. It was wrong to do that. But those bruises did not cause the child's death,"

Erika was charged with the death of Emmily but insisted Johnny Bermudez - her common law husband was
to blame.

Johnny Bermudez admitted to killing Emmily.

On a wire-tapped phone call Erika Mendieta was heard saying "I killed her myself."

Erika Mendieta was found guilty of manslaughter and was sentenced to 6 years in prison.

"In a moment of frustration as she rushed to pick up four of her other children from school, she lashed out at the cranky girl, severely injuring her head and spine"

Selena Parra was given custody of Erika Mendieta's four remaining children.

why is it that people how rob banks get way more than her sentance it should be higher she took a childs life which is unforgivable no matter what and that she get life or death penelty

You know, it's one thing to discipline a child. Discipline means punishing them for a wrong behavior and teaching them not to do it again. But beating a 2-year-old to death is not discipline, There is no valid reason or excuse. Beating a child is abuse, and in many cases like Emmily's, murder.

It truly baffles and bewilders me that anyone can harm their own child. I can understand a little smack when they are need to understand enough's enough, but to beat them while they are screaming in agony is an indication of mental instability and these people shouldn't be allowed to raise children. Makes you wonder if they should start finding a way to make sure people are stable before becoming pregnant so this kind of thing would dramatically reduce. People like this don't deserve children.

if you are going to report that your child is having seizures and all that, saying stuff like "my child has fallen down the stairs" is only gonna make things worse, because the evidence will be mounting up against you.

6 YEARS!???.. what a freakin INSULT to the memory of this little darling. I say bring back the 'Death Penalty". THIS so called 'mother' ADMITTED she killed her...therefore she is GUILTY ..take her out back & SHOOT her ..its as simple as that in my eyes! There is no room in this world for peices of 'human excrement', like the erika menieta's.The punishments handed down by the courts is an utter DISGRACE & there neeeds to be an ' overhaul' in the Justice System...world wide!
