It's funny, but I thought Gitmo was a prisoner of war prison. Meaning we send captives. If we can't take prisoners during military engagements, we are left with the option of either letting them go and having them continue to kill us, or kill them.
and what are we going to charge them with? being the enemy. Of course they are going to go free during a trial. The idea of a prisoner of war camp is to detain the enemy so they can't fight.
