there is always a tenuous balance between the authority of state vs federal. liberal vs conservative federal authority. our supreme courts redefine that line constantly.
but 'conservatives' supported extreme executive authority under bush...the terms are no longer relevant.

1) Some things are in our control and others not. Things in our control are opinion, pursuit, desire, aversion, and, in a word, whatever are our own actions. Things not in our control are body, property, reputation, command, and, in one word, whatever are not our own actions.
You're just backtracking now, changing your argument now as it wasn't working before.
My argument is not that anything IS by choice it's that being offended is NOT by choice. They're not the same thing.
People can offend by choice or by accident, it makes no difference to my argument. However people that ARE OFFENDED are not offended by their own choice. That would be stupid, why would anyone choose to be offended?
As for who decides what's offensive, well it's subjective, it's a personal thing.

Subjective does not entail choice, it entails personal belief or opinion.
Music is subjective because different people have different opinions on what is good or bad, but they don't have a choice as to what is good or bad.
