The courts could declare that the Tooth fairy lives on top of Mt. Rushmore, but that doesn't make it true. As for kidnapping, forcing Miller's daughter to live with Jenkins amounts to state-sponsored kidnapping

Lisa Miller entered into a civil union with Janet Jenkins in 2000. As a couple in a legal civil union, they decided to have a child by artificial insemination birthed by Lisa Miller during 2002. In 2003, the couple parted ways and had their civil union anulled like a divorce. The judge gave custody to the birth mother with liberal visitation rights to the other mother in the civil union. Miller, has not let Janet have contact with their daughter. And all because she turn evangelical....

Saying that Jenkins has "rights" because of her relationship with Lisa is the same argument boyfriends and girlfriends have when they assert that they have the rights to their partner's children because they live together or are active in the child's life.

Courts do not give such a pass to men and women living together. Are we sure that a non-marital union has those kinds of rights, because they don't work that way for men and women couples who aren't considered legally married.

If I have a child through artificial insemination, which implies that the male donor gave up all rights to the product of his sperm, and my egg provided the body for the child, then I am the only biological person connected to the child.

Now if I get MARRIED and my spouse adopts my child, then we can talk about spousal rights. Is that what Jenkins did-marry Lisa?

If not, then Jenkins has no rights to this child outside of arguing undue harm through separation. Otherwise where's her standing?
