One good general rule of thumb is to ask oneself, "what rightful powers (rights) are possessed, as a person like any other upon this earth, by any & all average citizens"? Then, whatever powers are not rightfully possessed & executed by any & all persons, neither can the government possess those powers. For the government is "we the people". Representatives & any

  • other public officials can possess only the powers that the people can delegate to them. The people cannot delegate to the government anything which the people do not rightfully possess. Thus, the governments powers should not ever exceed those possessed by the people. Otherwise, they represent only themselves as authoritarian rulers

  • the rightful power to delegate to the state government, used to tax tobacco above the rate of the state's general sales tax. It's clearly a violation of the US Constitution & it was wrong for it to have even been proposed

They hide behind their mommy's skirt. They'd prefer tobacco be illegal but know the ridiculousness of such an action. Especially while Marijuana is simultaneously becoming more legally obtainable. An exorbitant tax is their illegal alternative to the illegalization of tobacco
