There are many factors in how there is will another season such as does Tom really want to do another season with a bump in his paycheck and does CW really want to keep the show after clearly wanting to be a channel just geared towards young women?

In the original (Golden Age) comic superman didn't fly until 5 years after he started his career as Superman. The fact of the matter is that his story is rewritten and re-interpreted constantly in the comics. Why should there be a rule binding the Smallville charter to exactly follow them?

There are so many versions of Superman, it's not even funny. There is no set continuity. Superman didn't even fly when he was first created. There are versions where he could fly as a boy, hence Superboy. So, there is no real reason why Clark can't fly on Smallville except that they aren't allowed to do it (because of WB) and they don't want to do it (because that would mean the end of the show at this point).
