When asked to produce Id the 3rd time the officer had a right to arrest and hold him for up to 48 hrs until his ID could be established. The door to the garage being open allowed them to observe for any violation without a warrant. When they have the laws in place for dealing with illegal immigrants he could of been turned over to customs and held for violations under HomeLand security act
