@William Carr The application of indefinite detention to American citizens is considered unsettled law. Whenever faced with going to the Supreme Court, the government pled the case out. This codifies it into law and puts the burden of proof onto the defendant as to it's constitutionality. Besides, why would you put something and unpopular and unconstitutional into a bill if there was no purpose to it? If you get all your news from the Daily Kos, you're also going to be confused.

Actually, that wouldn't be a problem. Congress can't PASS a law that abrogates the Constitution or an Amendment.

So sure; stuff a denial of the Second Amendment into the next Defense Authorization Act.
