As the foundation of all our laws, the constitution is supposed to be fairly constant. It's supposed to be hard to change, and that's why not everything is spelled out in the constitution. If the government had to amend the consitution to act in an emergency, it would have been shredded a long time ago.

@sykopath66190 Do a web search , and you'll find that the consitution references the cabinet and departments of the executive branch but is DOESN'T lay out powers and duties for these officers, or what those departments will be. Now, based on the clause I already quoted it seems to me that congress assigns that authority, but, one thing's certain, you don't need an amendment in order to change what isn't there in the first place.

@sykopath66190 She's grandstanding, and in the most calculated and misleading way. Note that (after taking off her glasses dramatically for the cameras) she never directly implies that congress doesn't have the authority. She'd be wrong, and she'd be on the defensive. She never asks Geithner if congress has the authority. He'd say that they do, which everybody there knows is true, and that's in the end of.

@sykopath66190 What does she do? She gives him a pop quiz. It doesn't matter whether the law is constitutional or not, that's not the question. It only matters whether G has committed the appropriate clause to memory, and can recite it like a schoolboy reciting his latin verbs. If he can't, that's supposed to mean something. Of course Frank cut this ridiculous performance off. Every person in the room knew what crap she was pulling.

@gregkauf1987 really? They keep pointing to authority that the Congress "gave them" as opposed to the Constitutional means of granting new powers - amendments?
