Dexterity and balancing tests can be very problematic when trying to prosecute someone for DWI. You may have a medical condition that could prevent you from performing well in one of these tests --such as a bad back, knees, or ankles. An old injury could cause you to not perform well in this physical task. Also, what's the condition of the location in which you took the test? The test is supposed to be completed on a smooth surface. But, were you on gravel? Then there's the officer's ability to actually give instructions correctly, and your ability to listen correctly when nervous. Did he explain not to start and then you did so? Or you didn't start quick enough? These things can count against you and be clues to the officer you're intoxicated. Watch the video now to learn more.
