At the June 9, 2009 meeting of the Board of Equalization, the members voted 3-2 to sponsor legislation to limit attorney fees when taxpayers win against the government. This stems from a recent case in which the Board lost and was ordered to pay over $600,000 in attorney fees to a taxpayer who fought for 9 years to get justice. One take on this is the BoE legal staff is covering for their own bad advice to the Board members in pursuing this case instead of settling with the taxpayer years ago.
