Course Description:
As a result of the explosion of data created by the increased use of technology in business, the discovery process has become a significant burden for litigants and many law firms have opted to use Early Case Assessment ("ECA") to manage their cases. In this program, attorney Joseph Bartolo reviews how ECA can be extremely helpful for firms to perform a risk-benefit analysis, develop litigation strategies, formulate settlement plans, and prepare for litigation. Mr. Bartolo explains how ECA pushes parties to address discovery issues early on, which significantly aids in filtering out unimportant data and reducing electronic data discovery costs. He also discusses the 2006 revisions to the Federal Rules of Civil Procedure that were made to help alleviate many e-discovery disputes. Mr. Bartolo concludes his presentation by providing strategic and technical questions viewers can ask themselves to determine whether ECA is right for their case. This course should be helpful for all litigants seeking to find a better method to handle e-discovery matters.
