I agree with the precedent argument. Rulings like this just encourage employers to discriminate against the overweight even more. Plus, you don't really *need* the lapband surgery to lose weight. He could achieve the same effect with a liquid diet or another controlled calorie diet. The hospital just wants to milk the company for more money because they can.

I don't know if company should have to pay for the weight loss surgery. It could be covered by State Disability maybe, but while the company is culpable for the back injury it is not culpable for the overweight condition.

@travishirey I had a boss who told a coworker to move something heavy when she should have called facilities management. The coworker was injured because he followed instructions from his boss. Ruptured a disc in his spine and for the rest of his life he couldn't sit or stand in one position for more than half an hour. The company made him take an action that prevented him from earning a living for the rest of his life and that's HIS fault? Get over your damn self, narcissist.

i dont care who you are or where you are. if you get hurt its your fault more than anyone else's. i shot myself with a framing nail gun at work and paid the hospital bill. and showed up for work the next day. i actually felt bad that i held everyone up by having to go to the hostpital! get over yourselfs fat asses
