@jvand2651444 - I recently had to restore my ipod touch back to factory setting and ended up with firmware 4.2.1. I synced with iTunes and restored my settings. The only apps that loaded were the legit purchased apps. After I jailbroke the apps remained on there. So I assume the answer is yes. If not, they should be in your iTunes and you can sync to get them back. Hope that helps!
