im still under AT&T contract for an Iphone 3g. and my phone has been having problems lately. But i dnt have a warranty for it anymore. can i still send it back and get a new one?

I'll buy that iPhone for $352 at the most but that's only If apple can give me a new iPhone for the one I've got now coz it's got a crack on the back of it but it's out of warranty would they do that?
