brief video. End portion is not quite audible as of yet. While driving to get a coffee in Seymour, CT I was stopped at a police checkpoint. The policeman shined his light in my face and I rolled down the window. The office states that his probable cause to stop me is because I won't let him do his job. The policeman suspects that because I know my rights that I am a lawyer. After the policeman had me exit the vehicle he stated that I would be arrested for interfering with police and that he would make sure that I stay in the court system "....so long that it will bankrupt you" The other policeman stated that now he knows who I am and that, "...We'll be watching you all of the time. The policeman asked me what my problem was, I replied that I have no problem. The officer never answered my questions about defending the Constitution. Because I decided to leave my home to get a coffee, I was stopped by police without probable cause, detained, removed from my vehicle and threatened. More to come!!!!

    Uh, no!

    Connecticut statute 53a-167a only says you may not obstruct, resist, hinder, or endanger any peace officer in THE PERFORMANCE OF THEIR DUTIES.

    No police officer has a duty to violate a person's constitutional rights. So exercizing your constitutional rights is never interfering with a peace officer.

    Still, rather than relying on YOUR interpretation of the constitution, I suggest you rely on the U.S. Supreme Court's interpretation.

  • We're doing a DWI checkpoint. "Isn't that unconstitutional?" No. "Oh, ok. I thought I had a 4th Amendment." BAM!!!! Right off the bat!!! Slamin' him with the facts!

    I love it! Steve Murzin - Can you please add some annotations for dialog? I had to reply it many times to hear it. Annotations are extremely easy to use with practice.

  • @kayseeshuster: I fully support your right to believe "In regard to the fourth amendment a search is considered unreasonable if there is no search warrant or probable cause" even though that is completely different from the U.S. Supreme Court's rulings.

    THEY believe that "unreasonable" means without exigent circumstances or that benefits to the public of a search/seizure does not overcome a person's rights. For example, search of a vehicle with only probable cause is "reasonable".

  • @DavidForthoffer In the context of the English language, unreasonable means unfair or without sense. In regard to the fourth amendment a search is considered unreasonable if there is no search warrant or probable cause. Therefore you can not seize or search. When you stop a sovereign individual from traveling from point A to point B without probable cause or a search warrant you are seizing that individuals time amongst other things. Being in a motor vehicle is irrelevant.

    I don't interpret the Constitution. I have read it in the English language and understand it quite well. Allowing the Constitution to be interpreted is part of the problem. Although the teaching of English in our schools has become very weak the Constitution is basic enough for "The People" to read and understand without interpretation. If the Constitution was written in code or in a foreign language then I might need to interpret the document.
